Much of the front yard has been sodded. Driveway has been paved. Still some bare dirt, no silt fence, and slight sediment in roadway tracking to inlet. Still no inlet protection.

Silt fence not properly installed and not put in the appropriate locations rendering it useless.

Much of the front yard has been sodded. Back yard still bare dirt as it has been for at least 4 weeks. Pallets of sod in back yard. Hopefully the sod will be placed soon ended the erosion problem.

Owner ignored requests to beef up BMPs and repair the improperly installed silt fence. He indicated he did all that his Corps of Engineers permit calls for. Because this construction site lacks adequate BMP measures, owner was notified that Muddy Water Watch will be monitoring it for turbid storm water runoff. Turbid storm water runoff was documented. See photos. ADEM to be notifed but not requested to intervene because with sod pallets sitting in the back yard, it appears the ground will soon be stabilized. Why, after two warnings, did this turbid runoff have to happen? Permitting agencies, Landscape Architects, Building Architects, all seem to have failed to provide this owner with a BMP plan that adequately protects the waterway. Someone should not be able to dig up the entire yard to build a house, next to a waterway, without an engineer approved BMP plan. Why was the owner not required to have a Land Disturbance Permit? I am looking into the cause of this residential construction site BMP failure further.

Enforcement Log Notes: 
Nov 15, 2011: ADEM given a copy of this report. Turbid discharge was minor so they will not be asked to intervene at this time especially since it looks like the yard will be sodded soon. Should the yard not be sodded and there are more turbid discharges documented, ADEM will be requested to investigate. Nov 16, 2011: Talked to Mr. Steele about yesterday's turbid release. He said the silt fence had been fixed - trenched and stapled to deck. He thought the sod had been placed and immediately called his contractor. The contractor called me no long after and said they were laying sod. A brief heavy rain from a passing cold front occurred a couple of hours later today. Site investigation right after the rain revealed the sod pallets had been placed near the water providing for a wide strip of erosion control. Despite the rain event, the waters by the construction site were still clear. The addition of sod control site runoff. See add'l photo. The addition of a wide vegetative sod buffer between the remaining bare dirt and the waterway is adequate enough erosion control measure to close this case. No more monitoring necessary.
